Yes, your expired discipline can be removed from your personnel file. You’re generally talking about two years for a Letter of Warning unless the union has argued it down to a shorter duration. But after those two years, you can submit a request to have it removed.
One thing to know before doing so: Management will still have access to your expired discipline. So, while they can’t reference an old Letter of Warning to escalate discipline, they can ask about it in an interview to impeach the credibility of your testimony. Here’s an example:
I was issued a Letter of Warning for attendance during my first few years of service. The union had it thrown out because management issued it improperly. I haven’t had any discipline since. If I was in an Investigatory Interview and was asked, “Have you ever received discipline?” I would answer, “Yes,” even though it’s been thrown out. If you say, “No,” even though your file is clean, they can present evidence to call everything else you say into question.
